Terms & Conditions
It is agreed by and between Brazos Urethane, Inc. and the authorizing party (customer and/or customer's agent) that the following provisions are made as part of this contract:
Insurance by Contactor:
Brazos Urethane, Inc. warrants that it is insured for liability resulting from injury to person(s) or property and that all employees are covered by Worker's Compensation as required by law. Certificates of coverage are available upon request.
Scheduling/ Cancellation:
Brazos Urethane, Inc. will arrive on scheduled performance date. Schedules are contingent upon weather, accidents, and other delays beyond our control, and shall not be liable for damages due to those delays. Brazos Urethane, Inc. requests that the authorizing party provide at least 24 hours advance notice for cancellation.
Workmanship/Performance:
All work will be performed professionally, with the appropriate tools and equipment for proper job completion. Brazos Urethane, Inc. will not be responsible for any sprinkler lines or plumbing lines, especially frozen pipes, as it is our recommendation that these pipes are installed within heated spaces of the building (defined as spaces to be maintained at 50 degrees Fahrenheit). Brazos Urethane, Inc. will not be held responsible for any frozen water and plumbing pipes that burst, or cause loss of life, damage to property, or loss of use of property or any other damages.
Safety:
Brazos Urethane, Inc. warrants that all work will follow industry safety standards. The authorizing party agrees to not enter the work area during insulation operations unless authorized by the crew leader onsite.
Additional Work:
Any additional work or equipment required to complete the work will be addressed on-site and will be agreed upon by both parties and signed off on a work change order prior to commencing.
Licenses/Permits:
Brazos Urethane, Inc. is responsible for the costs of permits, licenses, and/or bonds required to perform specified worked under this contact to comply with all applicable local state and federal codes, rules and regulations. The customer/property owner shall be responsible for obtaining and paying for necessary approval from local HOA and other governing entities.
Insurance/Indemnity:
Brazos Urethane, Inc. is insured for liability resulting from injury to persons or property, and all its employees are covered by Worker's Compensation Insurance. The parties herein agree that in no instance may the customer seek damages in excess of Brazos Urethane, Inc. policy liability. Further, once work is completed by Brazos Urethane, Inc. under this contract, owner agrees to indemnify and hold harmless Brazos Urethane, Inc. and its agents for any injury, loss or expense associated with work performed or in any way related to services performed with this contract.
Completion of Contract:
Brazos Urethane, Inc. agrees to do its best to meet any agreed upon performance dates, but shall not be liable in damages or otherwise for delays due to inclement weather, labor or any other cause beyond its control; nor shall the customer be relieved of completion for delays.
Terms of Payment:
Unless otherwise noted in this proposal, the customer agrees to pay the account in full upon completion of the work. Failure to remit full payment within the payment terms will result in a finance charge up to the maximum amount allowable by State Law. Payments not received within 90 days may be turned over to collections.
Types of Payment Accepted:
Cash, Check, Visa, Master-card, Discover & American Express are all accepted.
Returned Check Fee:
There will be a $35.00 fee charged for all checks returned to our office for in-sufficient funds.
Governing Laws:
The terms and conditions of this contract shall be interpreted and governed according to the laws of the State in which a project is contracted. Brazos Urethane, Inc. operates in many States, and reserves the right to select the jurisdiction of choice.
Notice To Owner:
FAILURE OF THIS CONTRACTOR TO PAY THOSE PERSONS SUPPLYING MATERIAL OR SERVICES TO COMPLETE THIS CONTRACT CAN RESULT IN THE FILING OF A MECHANIC’S LIEN ON THE PROPERTY WHICH IS THE SUBJECT OF THIS CONTRACT. TO AVOID THIS RESULT YOU MAY ASK THIS CONTRACTOR FOR “LIEN WAIVERS” FROM ALL PERSONS SUPPLYING MATERIAL OR SERVICES FOR THE WORK DESCRIBED IN THIS CONTRACT. FAILURE TO SECURE LIEN WAIVERS MAY RESULT IN YOUR PAYING FOR LABOR AND CONSENT OF OWNER. CONSENT IS HEREBY GIVEN FOR FILING OF MECHANIC'S LIENS BY ANY PERSON WHO SUPPLIES MATERIALS OR SERVICES FOR THE WORK DESCRIBED IN THIS CONTRACT ON THE PROPERTY ON WHICH IT IS LOCATED IF HE IS NOT PAID.
